It’s being called the largest construction defect case in U.S. history, and is set to be heard September 2010. The plan is to take one federal suit to the manufacturer in China and the distributor in Germany. For Florida homeowner Richard Kampf, that is too long. The toxic drywall has taken it’s toll on his house and his finances. “I think monetary costs are not as great as emotional costs…waking up thinking about how we invested our life savings into this home only to realize that my house is worth nothing,” Kampf says.

Judge Eldon E. Fallon is expected to approve the grouping of 100,000 lawsuits into a single class action complaint. The defendants will reportedly be seeking total damages of more than $1 billion. Florida alone is expected to file 35,000 cases within the next year.

Attorney Ervin A. Gonzalez says, “This is the largest construction defect case in the history of the United States and consumers need help now. By consolidating the cases, the Court will allow for the more efficient and effective handling of these claims. Ultimately it should reduce the expense involved in litigating the cases and should promote global resolutions of these claims.”
